This is Atul kumar dwivedi a practicing advocate. I had bought a mobile set model ZT728 from the Hot Spots Retails Ltd., Shop No. G-2, Shri Ram Tower, Ashok Marg Lucknow by retail invoice, book no. 10, serial no. L/A/463 dated 04/08/2008 with an endorsement on the bill about its valid IMEI No. 354396080019601.
But suddenly the mobile set stopped functioning and after query from the network operator and internet I have come to know that the above mentioned IMEI No. as endorsed is invalid. This to me seems to be a intentional and deliberate act of misrepresentation amounting to consumer fraud for which suitable legal action can be initiated.
I hereby notice you to immediately replace the mobile handset within three days and pay me the damages of Rs. 50,000 towards the stress, inconvenience, business loss as well as breach of trust.
