Negligent Service And Damaged My Car Oil PanFeb

On July 23, 2009 I went to Xpress Lube at the aforementioned address and instructed the technicians there to change the oil in my car. I specifically asked for synthetic oil to be used. I then went to get some lunch and the gentleman I talked to told me that it would be done in 30 minutes. Upon my return I paid for the service and left. My boyfriend, who is a mechanic has just returned from South Dakota and upon checking my car.
He asked me why I switched from synthetic to conventional oil. I told him that I didn’t switch. He informed me that there was conventional oil in my car and he could tell because synthetic oil doesn’t have a burnt smell to it or a breakdown in viscosity. I contacted the Xpress lube and they are telling me that there is no way those they accidently put the wrong oil in my car.
He also said that they are expert mechanics and that they had a number of years of experience between them the person I spoke to basically said to me well, what do you expect us to do about it. At this point it became clear that they have no intention of making this situation right. He told me to bring to car back to their location for them to look at I live in New Jersey and it will be 2-3 weeks before I will be able to do that, with no guarantee that if I make the trip they will do anything for me.
In addition, they damaged my oil pan and the oil pan drain plug is completely stripped. My boyfriend said they must have used an impact wrench to remove it. It’s on so tight that I will have to take it to the dealership to have the plug removed and replaced. They eventually wrote back to tell me that they had a video of my car oil being changed and that the video shows the technician putting synthetic oil in my car. The problem is that I should see the video he could be saying anything to cover himself.
